Know Your Rights and Responsibilities
The Division of Workers' Compensation at the Texas Department of Insurance publishes many documents for employers. Read the Employer Rights and Employer Responsibilties publications in the Downloads box on the right side of this page. Please disregard the information on the Employer Responsibilties publication that refers to the Notice to New Employees and the right to reject coverage. Employees of political subdivisions have mandatory coverage under Chapter 504 of the Texas Labor Codes.
Get Familiar with Required Claim Reporting
The next step is to become familiar with injury and claim reporting. The Fund makes it easy for its members. Fund WC Program members may file all required claim reports on line. After reading the requirements for each form below, you can click on the Report a Claim tab at the top of the page or the links below to go to each claim form page. Employers are also required to give the Injured Employee Rights and Responsibilities Notice to the injured worker along with the First Report of Injury. Both the English and Spanish versions are located in the Downloads box on the right side of this page.
There are two. One for school districts (DWC-3SD) and one for all other employers in the state of Texas (DWC-3).

This form must be filed with the insurance carrier and injured worker.

When do I complete and send this form?
The DWC-3 and DWC-3SD must be sent within 30 days of the date the employer is notified income benefits are due. It is used by the insurance carrier to compute all income benefit types.

This form must be sent to the insurance carrier and the injured worker.

When do I complete and send this form?
This form must be completed within 10 days if an injured worker resigns or is terminated or has a change in earnings because of the compensable injury, this includes Post Injury Earnings such as sick leave.
The DWC-6 is also a work status report. It is required within 3 days when the injured worker returns to work, or is off work again after initially returning to work.
